Terms and conditions

In using this website you are deemed to have read and agreed to the following terms and conditions:

1. Definitions

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: 

 

"Student", “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions.

 

"The Company", “Myself”, “I” and "Me", "Teacher" refers to our Company.

 

“Party”, “Parties”, or “Us”, refers to both the Student and ourselves, or either the Student or ourselves.

 

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Student in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Student’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

2. Refund Policy 

It is not possible to get a refund on lessons purchased.  Before you purchase any lessons,  you are given a FREE lesson to decide whether you want to continue to learn with me or not. 

 

3. Rescheduling or cancellation of lessons 

A lesson may be rescheduled or cancelled but it must be done at least 24 hours prior to the lesson. If a lesson is cancelled within the 24 hour period prior to the lesson then the full lesson credit is payable and will not be re-credited and can be rescheduled. If no rescheduling has been made and a student fails to attend the lesson then that will be deemed as though they have attended and they will be charged for that lesson. Please note that this rule applies even if you are ill or because of a situation you have no control over.

 

4. Cancellation by the Teacher 

Occasionally the Teacher may have an unavoidable emergency or illness that could result in them having no option other than to cancel your lesson for that day or week. When this happens you will be sent an email as soon as the Teacher knows. You as the Student will not be charged the lesson credit for the cancelled lessons and you are free to re-book your lesson or lessons at a time when the Teacher advises you that they can recommence work.  

5. General scheduling of lessons 

Whilst I take reasonable steps to make myself available for lessons at times that are convenient to the Student, it is the sole responsibility of the Student to spread and schedule classes in a reasonable manner so as to avoid bunching. A Student can reserve a maximum of 1 lesson per day and can reserve their lessons up to 8 weeks in advance. I cannot accept reservations for more than 8 weeks in advance in order to allow me to organise my own personal and teaching schedule.

 

6. Changes to my lesson schedule

I may have to make changes to the time slots that are available for lessons. If you are currently studying with me and your usual time slot is disrupted, refunds are still not issued as other times are available.

7. Lesson attendance 

You must be on time for your lessons. The Teacher will wait for 10 minutes from the start time of the lesson and if after 10 minutes the Student does not connect to Skype/Zoom and start the lesson then the Teacher will treat that lesson as having been taken and no refund will be given for non attendance. When a Student starts a lesson late, the lesson will still finish at the scheduled end time. 

8. Regular study time

If a student prefers a fixed and regular study time with me each week, I try to provide this. However, this can sometimes change if for example another student books the same time before you do.  Therefore some flexibility is required with regard to fixed study times. Also note that students who have been studying with me for a long time have priority when it comes to lesson scheduling.



9. Expiry of lessons 
Lessons must be booked within three months from date of purchase.



10. Right to refuse / lesson terminations
I reserve the right to refuse lessons to any Student for any reason if I feel it necessary. I will inform the Student that I am unable to offer them classes and I do not require to give them a reason. I will not charge a Student when this happens for any unused lessons.


 

11. Increases in lesson prices

I reserve the right to increase lesson prices.  I try not to do this very often, however if lesson prices are increased, there is no guarantee that I will offer you the previous price you paid for lessons before the price increase. I am open to negotiate, but there are no guarantees that I be able to offer you the lower price.

12. Sharing lessons

Lessons purchased are only for yourself.  They cannot be shared with family or friends.

13. Studying in a quiet environment

If you are studying at home, please ensure that you have a quiet environment in which you can study English. If it’s too noisy around you in your house, it may not be possible to continue with lessons.

14. Suspension of lessons

If you want to suspend lessons for a period of time, please email me at brigitte@learnenglishasap.com If however you stop taking lessons without prior notice (more than for 28 days from the date of your last lesson), then your lesson package will expire. If you wish to restart lessons with me, you will need to purchase a new package.


15. Failed Internet connection 
If a Student connects to start a lesson and has an internet connection that is very poor (or fails) and the lesson cannot proceed as a result, then the Teacher may have to cancel the lesson for that day and the Student will have to be charged for that lesson. If the Teacher's Internet connection totally fails then the Student will not be charged for that lesson and they can rebook the lesson for another day. The maximum time that the Teacher will wait after a student has been disconnected is 10 minutes after which if the student has not reconnected to take the lesson then it is automatically cancelled and the Student is charged for that lesson.



16.  Invoices / Receipts 
In the event that any Student would like a receipt or invoice as proof of payment, then they should use the PayPal payment receipt that they will automatically receive directly from PayPal via email after they have made their payment. We do not offer additional invoices other than the PayPal ones. 

 

17. Links to this website

You may not create a link to any page of this website without our prior written consent. If you do create a link to a page of this website you do so at your own risk and the exclusions and limitations set out above will apply to your use of this website by linking to it.

 

 

18. Links from this website

I do not monitor or review the content of other party’s websites which are linked to from this website. Opinions expressed or material appearing on such websites are not necessarily shared or endorsed by me and should not be regarded as the publisher of such opinions or material. Please be aware that I am not responsible for the privacy practices, or content, of these sites. I encourage our users to be aware when they leave our site & to read the privacy statements of these sites. You should evaluate the security and trustworthiness of any other site connected to this site or accessed through this site yourself, before disclosing any personal information to them. This Company will not accept any responsibility for any loss or damage in whatever manner, howsoever caused, resulting from your disclosure to third parties of personal information.

 

 

19. Notification of changes

The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to the privacy policy, I will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how I use this site customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. Any changes to the privacy policy will be posted on our web site 30 days prior to these changes taking place. You are therefore advised to re-read this statement on a regular basis

 

 

These terms and conditions form part of the Agreement between the Student and myself. Your accessing of this website and/or undertaking of a booking or Agreement indicates your understanding, agreement to and acceptance, of the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.
